The tribunal had to commission its own research about the industry and rely on expert testimony from the PPCA. A much smarter approach for the clubs would have been to follow the US radio industry’s approach on radio royalties and point to the massive promotional and marketing services that DJs and nightclubs provide to record labels. After all if you’re a dance artist or label powerful DJs like Kid Kenobi can make or break your latest release by deciding whether to regularly include it in their playlists. In fact the record industry needs venues and DJs much more than DJs need labels because while sales of CD and records are declining revenues from live performances are going up. As The Economist has recently reported the problem for record labels is that while the music industry in general is growing the recording industry is not. In the long-term however the record labels may have shot themselves in the foot. This decision is likely to lead to calls for copyright law amendments as many aspects of the Copyright Tribunal’s decision are open to debate.

For the past few weeks Toronto has flirted with the. 500 mark only to repeatedly stumble another step in the wrong direction. As the Jays keep insisting that they haven’t fallen out of contention the perpetual dance has made gaining ground in either the American League East or Wild Card race nearly an impossible feat. n Monday night Toronto was once again within one victory of evening its record but New York used a trio of home runs to help issue the Jays a 6-4 loss in the Bronx. With the defeat Toronto has alternated wins and losses over its past eight contests and has gone 0-for-5 in its attempts to reach. 500 since it was last above the mark June 27. Coming off a four-game split in Boston the Blue Jays will need to win the next three games at Yankee Stadium if they want to end their eight-game trek away from Toronto with a series victory… “It’s been a stretch of close ballgames. A break here or a break there determines our fate. Thomas attempted to force such a break in the first inning against New York (46-44) which bumped Toronto (45-47) into third place in the division over the weekend. With two Blue Jays baserunners on and two outs in the opening frame the 39-year-old designated hitter convinced himself that Yankees left-hander Kei Igawa would send an offering to the inside portion of the plate. Instead Igawa sent a 2-2 fastball to the outside corner and Thomas flailed at the unexpected pitch. Thomas understands the unfortunate trend that has plagued Toronto over the past few weeks and he wanted to provide his club with an ample cushion in the early going. His strikeout turned out to be one of many missed chances that sent the Jays to another disheartening defeat.

_______________________Alternative fitness: I’m not quite sure what would count as alternative fitness — are we talking unusual ways to get exercise? r unusual exercises?Either way I would remind everyone that dancing is a great way to get fit and I don’t particularly mean taking a dance class either (though those are fun too). If you do go out and listen to music at a venue or a club instead of sitting at the bar downing empty calories you could be getting in a cardio workout! And it’s a great stress reliever as long as you remember that no one really cares what you look like on the dance floor but you!Vicky Hallett: So true! You don’t even need to go out to a club to do it either. In your living room you know nobody else is watching you. (As long as you close the blinds… Try shuffling around to different positions on the platform and consciously moving your effort to the upper body while lifting the heels for a bit. Wiggling the toes can also help as can varying the pace. If all else fails take a break and then restart. _______________________Washington D. : I’m a chef and have a very physically demanding job — lots of running up and down stairs with 30 lb. trays of food lots of heavy lifting hot temperatures long hours on my feet.
